What can you do if your ex is refusing your parenting time? There are many mechanisms available in order to enforce parenting time for a noncustodial parent or for that matter, a custodial parent. A parenting time enforcement action may be appropriate. That's a motion declaration in order that's filed with the court that says that your parenting time is being wrongfully denied. That can lead to penalties such as makeup parenting time. Could require the other party to post a bond. Contempt remedies are available, or the court could issue some manner of order, including an order compelling a hearing to change custody and or parenting time. A custodial parent also has the ability to get an order of assistance when their parenting time is being denied by a noncustodial parent. An order of assistance, once signed by a judge, goes to the Sheriff and a Sheriff can then execute that order and deliver the child. That's obviously an excessive remedy.
