What Does Probate Mean?

Probate is the legal process that occurs when a person dies and his / her estate is distributed.

The estate is distributed in one of two ways:

  • If there is a will, the estate will be distributed according to the terms of the will
  • If there is not a will, the estate will be distributed according to intestate succession laws

In terms of probate, the "estate" includes everything owned by the individual in question. This includes real property, cash, personal property, and so forth.
