What is Probate?
Probate is a legal process where assets are distributed under the court’s direction and oversight. When a party dies, a probate petition is drafted and filed with the court along with a living will. Assets are distributed according to a legal will, but if there is not one in place, the court must handle distribution according to Oregon law.
When is Probate Necessary?
Even if there is no will in place, the probate process isn’t a given. Oregon allows for an alternative solution for small estates with limited resources. For estates with less than $75,00 in personal property and less than $200,000 in real property, an Affidavit of Claiming Successor can be filed to handle asset distribution. This filing allows the beneficiaries of the estate to manage distribution.
There are some exceptions to this standard. Probate is necessary if:
- High-value accounts or property titles need to be transferred
- There are outstanding debts owed to the estate
- The distribution of the estate’s assets is being disputed
- The decedent’s will is being disputed
