Oregon Divorce Laws

Oregon is a “no-fault” divorce state, which means that a spouse does not have to prove that the other spouse is the blame of the end of the marriage. The only reason required is that “irreconcilable differences have caused the irremediable breakdown of the marriage,” which essentially mean the couple no longer gets along and there the problems in the marriage cannot be fixed.

There are two main types of divorce: contested and uncontested divorce. A contested divorce means the couple does not agree on one or more divorce-related issues, while an uncontested divorce means the couple agrees on all issues.

The following are the common types of divorce-related matters:

  • Property division – Oregon is an equitable distribution state, meaning that the court will divide the property between spouses in a fair manner, rather than equal. However, couples have the option of dividing their assets themselves and providing the court with their decision in a marital settlement agreement.
  • Child custody – There are two types of custody in Oregon: legal custody and physical custody. Legal custody refers to which parent will make decisions for the child (e.g., education, medical, religion, etc.), while physical custody refers to who will take care of the child and where the child will live.
  • Child support – This is an ongoing and periodic payment made by a parent in order to support the child (e.g., food, shelter, clothes, education, medical, etc.). The noncustodial parent is tasked to provide monthly payments.
  • Spousal support – Also known as alimony and spousal maintenance, if one spouse is incapable of maintaining the standard of living during the marriage, then the court may award the less-earning spouse monthly spousal support.

An uncontested divorce is considered more easier, simpler, and most cost-effective type of divorce. Couples who have no children and little to no assets, or those who agree on how to divide their assets, who will have legal and physical custody of the children, and how much alimony or child support should be provided, are good candidates for an uncontested divorce.

While a contested divorce can hotly combative, couples still have an opportunity to resolve their differences through mediation to finalize their divorce agreement outside the courtroom. Mediation sessions are led by a mutual third party—known as the mediator—who is tasked to encourage communication between the couple, suggest solutions that mutually benefit both parties, and help them come to an agreement. Yet, if the couple still cannot reach an agreement through mediation, then the divorce will go through court litigation, in which a judge will decide all divorce-related matters.
